Judicial independence and strengthening the rule of law in Latin America

Abstract

Judicial independence is an essential component of the consolidation of the rule of law in Latin America; however, its formal recognition does not necessarily ensure autonomous judicial action or effective constraints on political power. This study aimed to analyze its contribution to regional institutional strengthening and to identify the factors that promote or restrict its exercise. An exploratory literature review was conducted using a qualitative approach, a documentary design, and a thematic-comparative analysis of scientific articles, books, book chapters, and specialized reports. The findings show that effective judicial independence depends on transparent appointment systems, judicial stability, administrative autonomy, safeguards against political interference, and balanced accountability mechanisms. An autonomous judiciary was also found to promote oversight of public power, the protection of rights, legal certainty, and institutional legitimacy. Nevertheless, important gaps remain concerning the measurement of the phenomenon, the concentration of research on high courts, and the divide between formal and effective independence. It is concluded that strengthening judicial independence requires comprehensive, sustained policies adapted to the institutional characteristics of each country.
